Personal & Compassionate Representation

We know that there is no paycheck large enough and no lawsuit big enough to replace the person who was taken from you. For many, however, receiving some sort of financial compensation after a loss is extremely helpful during the grieving process. For example, family members no longer have to worry about making ends meet just to pay for emergency medical expenses. Financial stability can allow a family to concentrate on what’s important: healing and remembering their loved one.

Your financial compensation can also include:

  • Loss of wages, or future loss of wages
  • Pain and suffering
  • Loss of companionship or consortium
  • Medical bills due to injuries sustained prior to death
  • Funeral costs and burial expenses

Who Can File a Wrongful Death Suit in Kentucky?

Kentucky law is specific when it comes to wrongful death actions. An individual family member cannot come forward with a wrongful death suit – it must be the personal representative of the decedent’s estate. The personal representative may file the wrongful death action on behalf of the estate, and the proceeds of the lawsuit may be distributed among family members, as dictated by Kentucky law.

If a wrongful death case is successful, damages may be distributed as follows:

  • If the decedent was married and had no children, the surviving spouse would receive all damages.
  • If the decedent was married with children, the spouse and children would be entitled to equal amounts of the damages.
  • If the decedent did not have a spouse but had children, the children would receive all damages.
  • If the decedent had no spouse and no children, his or her parent/parents would receive all damages.
  • If the decedent had no spouse, children, or parents, the damages would go toward his or her estate.

Wrongful Death Statute of Limitations

In Kentucky, there is a one-year limit on the filing of a wrongful death claim. A claim must be filed within one year of the person’s death or within one year of the appointment of a personal representative to the decedent’s estate. Failing to adhere to this statute of limitations could mean that you relinquish your right to take legal action against the party that caused your loss, so we recommend moving quickly and discussing your options with an attorney at our firm.
